butcher and compradore in the Central Market, and that it was
agreed between us that, in lieu of interest thereon, he should
pay to me half the profits he might earn in carrying on the
said business; but it was further distinctly agreed that I
was in no way to be considered a partner with the said John
Tatam in the said business, nor was I to be concerned with any
debts or liabilities he might contract therein.

4. Had it occurred to me at that time that there might be
any objection to my making the said investment I should,
before doing so, have consulted the head of my Department,
Registrar of the Supreme Court, who, as hereinafter appears,
was subsequently made aware of the fact, but did not suggest
to me that I had acted incorrectly.

At the time of my making him the said advance John Tatam
was living in the same house with me; and, at his request, I
frequently assisted him in making up his books and accounts,
but I did so only at times when I believed myself to be --
entitled to employ myself as I pleased, and when the proper
performance of my duties as a Government servant was not
thereby interfered with in the slightest degree.

In addition to the said sum of $1,500 I made further
advances to the said John Tatam to enable him to carry on the
said business, but at the end of the year 1895, three months
after the said business had been commenced, it was found that
the same had been carried on by the said John Tatam at e loss,
and thereupon such business was let to one Yuen Cheong, who
continued to carry it on, without any assistance from, or
interference by, me, until the year 1897, when the said
business was transferred to one Tang Kee, who, I believe, still
carries it on, but in whom, end in which business, I have no
interest whatsoever.
